These Terms of Service ("Terms") govern your use of the website of Jobsplanetary Bharat Private Limited ("JBPL", "we", "us" or "our") and any HR, recruitment, staffing, payroll, compliance, training or consulting services we provide. By using our website or engaging our services, you agree to these Terms.
1. Our Services
JBPL provides HR services to businesses in India, including recruitment and staffing (permanent and contract), HR consulting, Virtual CHRO support, payroll and compliance management, performance management systems, and POSH & DEI training. The scope, timelines, deliverables and fees for each engagement are set out in a separate proposal, service agreement or work order ("Service Agreement"). If a Service Agreement conflicts with these Terms, the Service Agreement prevails.
2. Use of the Website
You agree to use this website only for lawful purposes. You must not:
- submit false, misleading or someone else's information, including in job applications or enquiries;
- attempt to gain unauthorised access to the website, its servers or any connected systems;
- upload files that contain viruses, malware or other harmful code;
- copy, scrape or reproduce website content for commercial use without our written permission.
3. Client Responsibilities
Clients agree to provide accurate job descriptions, employee data, payroll inputs and other information we reasonably need to deliver the services, and to do so on time. Clients remain responsible for final hiring decisions, employment terms offered to candidates, and the accuracy of data they provide to us. Delays or errors caused by incomplete or incorrect information may affect timelines and fees.
4. Candidates and Job Seekers
JBPL does not charge candidates any fee for job placement. Submitting your CV through our website does not guarantee an interview or employment. We may share your profile with prospective employers for roles that match your experience, as described in our Privacy Policy. Please be cautious of anyone asking for payment in JBPL's name and report such requests to us.
5. Fees and Payment
Fees for our services are as agreed in the relevant Service Agreement and are subject to applicable taxes, including GST. Unless agreed otherwise, invoices are payable within the period stated on the invoice. Refunds, cancellations and candidate replacements are covered by our Refund Policy.
6. Non-Solicitation
Where a candidate introduced by JBPL is hired by a client, or by any company related to the client, within the period stated in the Service Agreement, the agreed placement fee becomes payable, whether the hire happens directly or through another channel.
7. Confidentiality
Each party will keep confidential any business, employee or candidate information received from the other in the course of an engagement and will use it only for the purpose of that engagement, except where disclosure is required by law.
8. Intellectual Property
All content on this website, including text, graphics, logos and images, is owned by or licensed to JBPL and is protected by applicable intellectual property laws. Training materials, policy templates and reports we prepare remain our property unless the Service Agreement states otherwise; clients receive a licence to use them for their internal business purposes.
9. Limitation of Liability
We deliver our services with reasonable skill and care. However, we do not guarantee the future performance, conduct or tenure of any candidate placed with a client. To the extent permitted by law, JBPL is not liable for any indirect, incidental or consequential loss, and our total liability for any claim relating to an engagement is limited to the fees paid for that engagement in the three months before the claim arose.
10. Third-Party Links
Our website may link to third-party websites, such as Google Maps. We are not responsible for the content or privacy practices of those websites.
11. Changes to These Terms
We may update these Terms from time to time. The revised version will be posted on this page with a new "Last updated" date. Continued use of the website or our services after changes are posted means you accept the revised Terms.
12. Governing Law
These Terms are governed by the laws of India. Any dispute arising from them is subject to the exclusive jurisdiction of the courts at Indore, Madhya Pradesh.
